Privacy Policy

This Privacy Policy explains how Backcountry Forecast ("Backcountry Forecast," "we," "our," or "us") handles information when you use Backcountry Forecast (the "Service"), including via SMS, satellite messaging, the web portal, an app (if applicable), or any APIs we may offer, and when you communicate with us for support. We aim to collect only what is necessary to operate and improve the Service, and to handle information responsibly and transparently. This Privacy Policy is incorporated into our Terms of Service.
1. Information We Collect
We collect information in the following categories:
Information you provide
- Account information, such as your name, email address, and other details you submit.
- Device and contact information, such as phone numbers, satellite-messaging identifiers, carrier and country information, and device-related details you provide or that are necessary to route messages.
- Message content and requests, including the contents of messages you send to the Service and the Service's responses. Messages may include precise location data (e.g., GPS coordinates) if you provide it.
Information collected automatically
- Usage and technical data, such as timestamps, logs, request/response metadata, basic diagnostics, and information about how you interact with the Service (including through the web portal or APIs).
Payment information
- If you purchase paid features, payments are processed by Stripe. We do not receive or store full payment card numbers, but we may receive billing-related information such as payment status, partial identifiers, and subscription details.
2. How We Use Information
- To provide and operate the Service, including delivering forecasts and alerts you request or enable, routing messages, and maintaining linked devices.
- To verify and secure accounts, including OTP/verification messages, fraud prevention, and abuse detection.
- To provide customer support and respond to inquiries.
- To improve and develop the Service, including debugging, performance analysis, and feature development.
- To communicate with you, including service-related notices, billing or subscription communications, and alerts you enable.
- To send marketing communications by email or in-product, subject to applicable law and your opt-out choices (see Section 7).
- To comply with legal obligations and enforce our Terms of Service.
3. How We Share Information
Service providers, messaging networks, and intermediaries
We use third parties to operate and deliver the Service (for example: cloud hosting, databases, monitoring/logging, customer support tooling, email delivery, and payment processing). In addition, messages you send or receive may be carried by mobile carriers, satellite operators, device providers, or other intermediaries. These third parties may process information to provide their services, and such processing may be governed by their own terms and privacy policies.
Legal and safety reasons
We may disclose information if we believe in good faith that disclosure is necessary to comply with law, respond to lawful requests, protect rights and safety, investigate fraud or abuse, or enforce our Terms.
Business transfers
If we undergo a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction.
Do Not Sell or Share
We do not sell your personal information, nor do we share personal information for cross-context behavioural advertising.
SMS Opt-In Data
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign, except as required by law. We may share your SMS opt-in or consent status with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.
4. Data Retention
We retain personal information (including message content and any coordinates you provide) for as long as reasonably necessary for the purposes described in this Privacy Policy, including operating the Service, maintaining records, improving features, and meeting legal or security needs.
We may also create de-identified or aggregated data that does not reasonably identify you, and we may retain and use such data for lawful purposes.
5. International Data Transfers
We may store or process information in Canada and other countries where we or our service providers operate (including the United States). When information is processed outside your jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, law enforcement, or national security authorities.
6. Security
We take reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or destruction. However, no system is completely secure, and we cannot guarantee absolute security of information.
7. Your Choices
Service communications
You may receive service-related communications necessary to operate your account and the Service (such as verification messages, security notices, billing communications, and alerts you enable).
Marketing communications (email and in-product)
Subject to applicable law, we may send you marketing or promotional communications by email or within the web portal or app. Where prior consent is required by law, we will obtain it; where the law allows, we may enroll you by default when you sign up. You can opt out of marketing communications at any time by using the unsubscribe link in our emails, contacting support@backcountryforecast.com, or, where offered, by adjusting your account preferences. Opting out of marketing communications does not affect your receipt of service-related communications.
Access, correction, and deletion
You may request access to, correction of, or deletion of your personal information by contacting us at support@backcountryforecast.com. We will respond within a reasonable time and within the time required by applicable law.
8. Cookies and Similar Technologies
Our web portal may use strictly necessary cookies (for example, to keep you logged in and maintain session security). We do not use analytics or advertising cookies by default.
9. Children's Privacy
The Service is not intended for individuals under 16 years of age, and we do not knowingly collect personal information from children under 16.
10. Additional Notice for EEA/UK/Switzerland Users
- We process personal information based on lawful grounds such as performance of a contract, legitimate interests, and consent where required.
- You may have rights to access, correct, delete, restrict, object, and receive a portable copy of certain personal information, and the right to lodge a complaint with a supervisory authority.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Changes take effect when posted with a new Effective Date.
